Sweepstakes Rules
Effective Date: August 4, 2026
NO PURCHASE OR PAYMENT NECESSARY TO PARTICIPATE. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE A PARTICIPANT’S CHANCES OF WINNING.
Gains.com is an online platform which offers Participants the chance to play games for entertainment and enjoyment. Gains.com also gives away sweepstakes entries referred to as “Sweeps Coins” as set out in these Sweeps Rules. Sweeps Coins can be used to Participate in Promotional Play for a chance to win further Sweeps Coins which are redeemable for real prizes.
SPONSOR/PROMOTER WILL ONLY PROCESS A PRIZE REDEMPTION IF THE REDEEMED VALUE OF THE PRIZE IS US$100 OR MORE (I.E., A MINIMUM OF 100 ELIGIBLE SWEEPS COINS). CONSEQUENTLY, A PARTICIPANT'S CUSTOMER ACCOUNT MUST HAVE A BALANCE OF AT LEAST 100 SWEEPS COINS BEFORE REQUESTING A PRIZE REDEMPTION.
These Sweeps Rules are to be read in conjunction with the Gains.com Terms and Conditions (T&Cs). Terms which are defined in the T&Cs have the same meaning in these Sweeps Rules.
PLEASE NOTE THAT THESE SWEEPS RULES INCORPORATE THE SECTION OF THE TERMS AND CONDITIONS TITLED 'BINDING ARBITRATION AND CLASS ACTION WAIVER', WHICH INCLUDES A PROVISION WAIVING THE RIGHT TO PURSUE ANY CLASS, GROUP OR REPRESENTATIVE CLAIM AND REQUIRING YOU TO PURSUE PAST, PENDING, AND FUTURE DISPUTES BETWEEN YOU AND US THROUGH INDIVIDUAL ARBITRATION UNLESS YOU OPT OUT WITHIN THE SPECIFIED TIME FRAME. SEE CLAUSE 11 OF THESE SWEEPS RULES FOR MORE INFORMATION.
1. Eligibility to Play Gains.com
- In these Sweeps Rules:
- Eligible Participants means legal residents of the Permitted Territories who are physically located in the Permitted Territories at the time of participation and are at least eighteen (18) years old or the age of majority in their jurisdiction (whichever occurs later);
- Permitted Territories means the fifty (50) states of the United States and Washington, DC (other than the states of California, Connecticut, Idaho, Indiana, Louisiana, Maine, Michigan, Montana, Nevada, New Jersey, New York, Tennessee and Washington State);
- Participant means a person who participates in Promotional Play;
- Postal Request Code: has the meaning set out in clauses 3.3(a) and 3.4 of these Sweeps Rules;
- "Sweepstakes Period" means the ongoing promotional period during which Sponsor/Promoter offers sweepstakes entries and awards prizes on the Gains.com platform. Sponsor/Promoter may, in its sole discretion, designate separate Sweepstakes Periods from time to time, which may be identified on the Gains.com website or application. Sponsor's/Promoter's computer is the official timekeeping device for the Sweepstakes.
- Promotional Play means Gains.com’s sweepstakes promotions. Promotional Play is only open to Eligible Participants, who are at least eighteen (18) years old or the age of majority in their jurisdiction (whichever occurs later) at the time of entry. PARTICIPATION IS VOID WHERE PROHIBITED BY LAW.
- The Sweepstakes is subject to all applicable federal, state, and local laws and regulations. It is the sole responsibility of a Participant to determine whether the Sweepstakes is legal and compliant with all regulations in the jurisdiction in which the Participant resides.
- Participation constitutes the Participant’s full and unconditional agreement to these Sweeps Rules and Sponsor’s/Promoter’s decisions, which are final and binding in all matters related to the Sweepstakes.
- Winning a prize is contingent upon fulfilling all requirements set out in these Sweeps Rules.
- Employees of GamerGains Labs Inc., any of their respective affiliates, subsidiaries, holding companies, advertising agencies, or any other company or individual involved with the design, production, execution, or distribution of the Sweepstakes and their immediate family (parents, spouse, children, and siblings, whether the relationship is by birth, marriage, or adoption) and household members (people who share the same residence at least three (3) months of the year) are not eligible to participate. Such persons may access the Service for testing and quality assurance purposes but may not win or redeem prizes.
- Sponsor/Promoter and its service providers, including game providers, may verify a Participant's physical location using IP address, network and device signals, and, where the Participant grants the applicable permission, device location services. Participation may be unavailable where a Participant's location cannot be verified.
2. Sponsor/Promoter
The Sponsor/Promoter of the Sweepstakes is GamerGains Labs Inc., 25 SE 2nd Ave Ste 550 #802, Miami, FL 33131
The Sweepstakes is sponsored and administered solely by GamerGains Labs Inc. Apple Inc., Google LLC, and Meta Platforms, Inc. are not sponsors of, and are not affiliated with or responsible for, the Sweepstakes in any manner. Any questions, comments, or complaints regarding the Sweepstakes must be directed to Sponsor/Promoter, not to Apple, Google, or Meta.
3. How to Collect Sweeps Coins
Sweeps Coins cannot be purchased under any circumstances. Sweeps Coins have no monetary value, are not property, and may only be used to participate in Promotional Play and to request a prize redemption in accordance with these Sweeps Rules, subject to Sponsor's/Promoter's verification and approval. Any purchase of Gold Coins is a purchase of Gold Coins only; Sweeps Coins provided as a free bonus with a Gold Coin purchase are always provided free of charge, and no purchase is ever necessary to collect Sweeps Coins.
- To Participate, you must have an active Customer Account. If you do not have a Customer Account, you can create one free of charge at https://gains.com. To enter the Sweepstakes, a Participant must access Gains.com at https://gains.com and sign in to their Customer Account.
- Once they have accessed Gains.com, there are four potential ways for an Eligible Participant to collect Sweeps Coins:
- Receive Sweeps Coins as a free bonus when purchasing Gold Coins. Each Participant may receive Sweeps Coins as a bonus upon the purchase of specifically marked packs of Gold Coins. Gold Coins can be used for social game play in Gains.com. Gold Coins cannot be redeemed for prizes. The number of Sweeps Coins a Participant will receive as a bonus for each relevant Gold Coin purchase will be stated in the website purchase window. All purchases of Gold Coins are final and no refunds will be given.
- Receive Sweeps Coins when entering Sweeps Coins no-cost giveaway contests on the Gains.com Social Media pages. The Sponsor/Promoter regularly holds Sweeps Coins no-cost giveaway contests which Participants can enter by following the instructions provided in the contest. These giveaways may require sharing the Facebook, X, Discord, or other page posts or answering various game-related questions to be eligible for entry. The amount of Sweeps Coins given away will be stated on the applicable Sweeps Coins no-cost contest post and will be added to each contest winner’s Customer Account.
- Receive Sweeps Coins by logging into your account. Participants can receive free Sweeps Coins on a daily basis by taking the following steps (Daily Bonus): 1) Navigate to the wallet page 2) Click on Daily Bonus 3) Click Claim Daily Bonus. Participants can only claim a Daily Bonus once per day (the daily clock resets every 24 hours after the user claims).
- Receive Sweeps Coins by sending a request by post. Participants can receive free Sweeps Coins by obtaining a Postal Request Code and sending a standard postcard or piece of white paper (Request Card) which must be 4” x 6”, unfolded, blank, unlined card stock containing no pre-printed content, and placed inside a stamped #10 envelope addressed in handwriting, to the following address and satisfying the requirements set out below:

- FOR THE AVOIDANCE OF DOUBT, COMBINED REQUESTS SENT VIA PACKAGE OR PARCEL DO NOT MEET THE REQUIREMENTS SET OUT IN THESE SWEEPS RULES AND ARE INVALID.
- There is a limit of one (1) Request Card per outer envelope and one (1) Postal Request Code per Request Card. There is no limit on the number of valid Request Cards a Participant may submit. For each valid Request Card submitted in accordance with the requirements below, the Participant will receive three (3) Sweeps Coins, which will be added to the Participant's Customer Account upon verification.
- Generation and Use of Postal Request Codes – A Postal Request Code may be generated through the Participant's Customer Account on the Platform. There is no limit on the number of Postal Request Codes a Participant may generate, subject to reasonable rate limits and cooling-off periods applied uniformly to prevent automated or scripted generation. Each Postal Request Code is single-use and is valid for ten (10) days from the date it is first displayed (the "Validity Window"), after which it automatically expires. Generation of a new Postal Request Code does not affect the validity of any previously generated code. Any Request Card containing a Postal Request Code that was expired as of the postmark date, or that has already been used, is void and ineligible for credit.
- Mailing Requirements and Deadlines – All Request Cards must be postmarked within ten (10) days of the date the Postal Request Code is displayed (i.e., within the Validity Window). Any Request Card postmarked after this period, or containing an expired Postal Request Code, will be void and ineligible to receive Sweeps Coins. Sponsor/Promoter reserves the right to verify postmark dates and to reject any Request Card that, in its sole discretion, appears to have been back-dated or otherwise falsified.
- Form of Request Card – Participants must hand-write their return address on the front of the envelope and the words "Sweepstakes Entries." On one side of the Request Card inserted inside the envelope, Participants must hand-write, in the following order: (i) in the top-left corner, one (and only one) unique one-time Postal Request Code generated through their Customer Account; (ii) their full name as shown on government-issued identification; (iii) the email address registered to their Customer Account; (iv) the return or residential address registered to their Customer Account; (v) the following statement: "I wish to receive Sweeps Coins to participate in the sweepstakes promotions offered by Gains.com. By submitting this request, I declare that I have read, understood, and agree to be bound by Gains.com's Terms and Conditions and Sweeps Rules."; and (vi) their signature and the date, written beneath the declaration. All information on the Request Card must be handwritten solely by the Participant, signed in their own name, and must be legible; illegible Request Cards are void, as determined by Sponsor/Promoter in its sole discretion. Use of any method that simulates handwriting (including printing, stamping, or machine-assisted writing) will void the request; repeated or fraudulent abuse of the postal entry process may result in closure of the Customer Account. Sponsor/Promoter may require additional verification, including video verification, where it reasonably suspects abuse of the postal entry process.
- Validity and Prohibited Conduct – THE REQUEST MUST ONLY BE MADE BY THE PARTICIPANT AND MUST BE POSTED FROM THE SAME STATE AS THE PARTICIPANT'S VERIFIED RESIDENTIAL ADDRESS. Requests made by any other individual or entity (including but not limited to commercial sweepstakes subscription or entry services), requests submitted in excess of the daily limit, or requests posted from a different state will be declared invalid and Sweeps Coins will not be credited. Tampering with the entry process or operation of the Sweepstakes —including but not limited to using devices or software to automate the request process or circumvent time limits— is prohibited and any Request Cards deemed by Sponsor/Promoter, in its sole discretion, to have been submitted in this manner will be void. In the event a dispute arises regarding the identity of the individual who submitted a Request Card or whether a Request Card complies with these requirements and the matter cannot be resolved to Sponsor/Promoter's satisfaction, the affected Request Card will be deemed ineligible.
- A Postal Request Code is a unique combination of 12 digits that Participants can obtain by following the steps outlined in clause 3.5 of these Sweeps Rules. A Postal Request Code is unique, can only be used once, and is valid for ten (10) days from the date it is first displayed, after which it expires. The purpose of a Postal Request Code is to assist with the efficient and effective processing of a Participant’s Request Card. Request Cards containing a Postal Request Code that was expired as of the postmark date will be void. A POSTAL REQUEST CODE CAN ONLY BE USED BY THE PARTICIPANT WHOSE CUSTOMER ACCOUNT WAS USED TO GENERATE THAT POSTAL REQUEST CODE. Any Participant suspected by Sponsor/Promoter to have directly or indirectly provided a Postal Request Code to another person may, in the sole discretion of Sponsor/Promoter, be disqualified and lose their eligibility to Participate in the Sweepstakes.
- A Postal Request Code can be obtained by following each of these steps:
- sign into your Customer Account;
- click on the “Postal Request Code” link in the Lobby Footer;
- click on the “Postal Request Codes” button and follow the prompts.
- The Postal Request Code is then displayed, and may be re-viewed through the Participant's Customer Account at any time before it expires; re-viewing a code does not extend its Validity Window.
- The amount of Sweeps Coins a Participant has will be displayed in their Customer Account on the website. The amount of Sweeps Coins to be allocated to Participants may be changed prospectively by Sponsor/Promoter by amendment to these Sweeps Rules in accordance with clause 9.5.
- Sponsor/Promoter is not responsible for lost, late, incomplete, invalid, unintelligible, or misdirected Sweeps Coins requests or allocations.
- In the event of a dispute as to any registration of a Customer Account, the authorized account holder of the email address used to register the Customer Account will be deemed to be the Participant. The “authorized account holder” is the natural person assigned the email address by an internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted address.
- Use of any automated or other system(s) to Participate, to acquire Sweeps Coins, or play the games is prohibited and will result in disqualification and loss of eligibility to Participate in the games. Use of multiple Customer Accounts, false or borrowed identities, or collusion with other persons to participate in the Sweepstakes, collect Sweeps Coins, or redeem prizes is strictly prohibited and may result in disqualification, closure of all associated Customer Accounts, and forfeiture of all Sweeps Coins and pending redemptions, in Sponsor's/Promoter's sole discretion.
- Sweeps Coins are only valid for sixty (60) days from the date a Participant last logged on to their Customer Account and will then automatically expire. For Customer Accounts existing as of the Effective Date of these Sweeps Rules, the sixty (60) day period will be measured from that Effective Date. Sponsor/Promoter will provide reasonable advance notice by e-mail to the address on file before any Sweeps Coins expire.
- Sweeps Coins may also be forfeited if a Participant’s Customer Account is closed for any reason, or at the Sponsor/Promoter’s discretion.
4. Using Sweeps Coins to Play Games
- Participants with Sweeps Coins can use those Sweeps Coins to play games within Gains.com for a chance to win additional Sweeps Coins. Sweeps Coins won through game play can be redeemed for real prizes.
- Within Gains.com, there are different games. The amount of Sweeps Coins required to play each game will be detailed next to the game. A Participant may be able to increase the amount of Sweeps Coins they play the game with so they can increase their potential winning eligibility.
- Only games played with Sweeps Coins provide the opportunity to redeem winnings for real prizes. The prize that can be won while playing a game will be shown in Gains.com by clicking the “Win Table” or “Pay Table” button, denominated as “Sweeps Coins”.
- Each Sweeps Coin that has been won through game play (rather than collected using one of the methods described in clause 3 of these Sweeps Rules) can be redeemed for a prize with value being equivalent to $1.00 USD.
- Sponsor’s/Promoter’s decisions as to the administration and operation of the Sweepstakes, the game, and the amount of winnings are final and binding.
- Unless Sponsor/Promoter requires otherwise, any Sweeps Coins allocated to a Participant are required to be played at least once before they are eligible to be redeemed for prizes. Sponsor/Promoter may, in its sole discretion, require that any Sweeps Coins allocated to a Participant must be played a greater number of times (not exceeding 20) in any combination of Sweeps Coins games before they are eligible to be redeemed for prizes.
- Sponsor/Promoter reserves the right to change game pay tables at any time. A Participant can see the current pay table for a game by clicking the “Win Table” or “Pay Table” button within the game and should review it before playing.
5. Verification and Confirmation of Potential Winners
- POTENTIAL SWEEPSTAKES WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR/PROMOTER (IN ANY MANNER IT MAY CHOOSE) AND THE DECISIONS OF SPONSOR/PROMOTER ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE SWEEPSTAKES. A PARTICIPANT IS NOT A WINNER OF ANY PRIZE, EVEN IF THE ONLINE SCREEN INDICATES THEY ARE, UNLESS AND UNTIL THE PARTICIPANT’S ELIGIBILITY AND THE POTENTIAL WINNING PLAY HAS BEEN VERIFIED AND THE PARTICIPANT HAS FULLY COMPLIED WITH THESE SWEEPS RULES AND BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. SPONSOR/PROMOTER WILL NOT ACCEPT SCREENSHOTS OR OTHER PURPORTED EVIDENCE OF WINNING IN LIEU OF ITS VALIDATION PROCESS.
- Potential prize winners must comply with these Sweeps Rules and winning is contingent upon fulfilling all requirements.
- A potential prize winner may be required to sign and return to Sponsor/Promoter, an affidavit/declaration of eligibility, and liability/publicity release (except where prohibited) in order to claim his/her prize (if applicable).
- FOR ANY SINGLE PRIZE REDEMPTION OR CUMULATIVE WINNINGS IN A ROLLING 24-MONTH PERIOD EXCEEDING US$5,000, SPONSOR/PROMOTER WILL CONDUCT ENHANCED VERIFICATION PRIOR TO PROCESSING PAYMENT. SUCH VERIFICATION MAY INCLUDE GOVERNMENT-ISSUED PHOTO IDENTIFICATION, PROOF OF RESIDENTIAL ADDRESS, PROOF OF BANK ACCOUNT OWNERSHIP FOR THE ACCOUNT RECEIVING THE PRIZE REDEMPTION, RECENT BANK STATEMENTS, PAY SLIPS, TAX RETURNS, OR OTHER DOCUMENTATION EVIDENCING LAWFUL SOURCE OF FUNDS, AND/OR ANY ADDITIONAL INFORMATION OR DOCUMENTATION REQUIRED TO COMPLY WITH APPLICABLE ANTI-MONEY LAUNDERING (AML), KNOW-YOUR-CUSTOMER (KYC), AND COUNTER-TERRORIST FINANCING OBLIGATIONS. FAILURE TO PROVIDE ANY REQUESTED DOCUMENTATION WITHIN SEVEN (7) DAYS OF REQUEST, OR PROVISION OF FALSE, MISLEADING, OR INCOMPLETE INFORMATION, MAY RESULT IN DELAY, SUSPENSION, OR CANCELLATION OF PRIZE REDEMPTION, ACCOUNT SUSPENSION, AND/OR FORFEITURE OF PRIZES, IN EACH CASE WITHOUT LIABILITY TO SPONSOR/PROMOTER.
- If a potential winner cannot be contacted, fails to properly execute and return the affidavit/declaration of eligibility and liability/publicity release within the required time period (if applicable), fails to comply with these Sweeps Rules, or if the prize or prize notification is returned as undeliverable, that potential winner forfeits the prize.
- In the event that a potential winner of a Sweepstakes prize is disqualified for any reason, Sponsor/Promoter may, in its sole discretion, reseed the prize back into the Sweepstakes.
6. Prizes
- A Participant’s Sweeps Coins balance is shown in the Participant’s Customer Account.
- Prizes are not awarded until redeemed. A Participant has no rights to Sweeps Coins that have not been redeemed.
- Where a Participant has chosen to redeem prizes for cash, the payment will be made in USD (or, for redemptions paid to a digital-asset wallet, in USDC as provided in clause 6.4) to the financial account or online wallet from which you purchased Gold Coins, or if this is not technically possible, then to an alternative bank account you nominate. Sponsor/Promoter reserves the right to require the use of the same payment method for redemption of prizes as was used to purchase Gold Coins, or a specific payment method at Sponsor/Promoter’s discretion.
- Cryptocurrency Purchases & SC Redemptions: If you purchase Gold Coin (GC) packages using cryptocurrency — including Bitcoin (BTC), Ethereum (ETH), Solana (SOL), USD Coin (USDC), or Tether (USDT) — any Sweepstakes Coin (SC) prizes you redeem will be paid out exclusively in USD Coin (USDC), regardless of the cryptocurrency used for your original Gold Coin purchase. For example, if you purchased GC with Bitcoin, Ethereum, Solana, or USDT, your SC redemption will still be fulfilled in USDC. Crypto-to-crypto conversions for redemptions are not supported.
- Sponsor/Promoter will only process a prize redemption if the redeemed value of the prize is US$100 or more (i.e., a minimum of 100 eligible Sweeps Coins). Consequently, a Participant’s Customer Account must have a balance of at least 100 Sweeps Coins before requesting a prize redemption.
- TO BE ELIGIBLE FOR A SWEEPS COINS PRIZE OR A SWEEPS COINS PRIZE REDEMPTION:
- A PARTICIPANT MUST BE AN ELIGIBLE PARTICIPANT; AND
- THE PARTICIPANT’S DETAILS MUST MATCH THOSE OF THE PARTICIPANT’S CUSTOMER ACCOUNT.
- In Florida (and, if the Service becomes available there, New York), the maximum aggregate value of prize redemptions per Participant per calendar day is US$5,000.
- Sweeps Coins obtained exclusively through Daily Bonuses are subject to maximum winnings and redemption cap value of US$100 per Participant. This means that, across your entire participation, the total maximum amount you can redeem from Daily Bonus Sweeps Coins is limited to the value of US$100. Sweeps Coins obtained exclusively through Daily Bonuses exceeding the maximum cap value of US$100 will be debited (removed) from your account balance. Sweeps Coins obtained as a bonus with the purchase of a Gold Coin package priced at less than US$20.00 are subject to a maximum redemption value of US$1,000 for any single spin, hand, play, or other single game outcome. Any prize amount exceeding the applicable limit will be reduced to the maximum allowable amount. These limitations do not apply to Sweeps Coins obtained through any other method or as a bonus in connection with a Gold Coin package priced at US$20.00 or more.
- Sponsor/Promoter reserves the right, in its sole discretion, to limit a Participant’s redemption of Sweeps Coins to US$10,000 per day or any other amount over any time that Sponsor/Promoter considers necessary to satisfy its regulatory obligations or the requirements of its partners and suppliers.
- Sponsor/Promoter is not responsible for any taxes or fees associated with a prize redemption. Participants are responsible for all applicable taxes and fees associated with prize receipt and/or redemption. Where required for tax reporting or withholding under applicable law, a winner agrees to provide Sponsor/Promoter with a valid Social Security number, IRS Form W-9, or other required information as a condition of the applicable prize redemption, and acknowledges that Sponsor/Promoter may withhold and remit a portion of any prize where required by law, and may issue tax documentation (including IRS Form 1099) electronically.
- Sponsor/Promoter is not responsible for any foreign exchange transaction fees, charges, or related costs that may be incurred as a result of, or in relation to, a prize redemption, including but not limited to any losses or additional costs arising from foreign exchange fluctuations.
- Sweeps Coins are not transferable and no substitution will be made except as provided herein at the Sponsor’s/Promoter’s sole discretion. Sponsor/Promoter reserves the right to substitute the listed prize of equal or greater value for any reason owing to circumstances outside Sponsor’s/Promoter’s reasonable control.
- Winning outcomes are displayed in the Participant’s Customer Account and gameplay history. For any discrete advertised promotion, winners will be notified by email.
- Sponsor/Promoter reserves the right to charge payment processing fees (each, a "Redemption Processing Fee") in connection with processing a prize redemption. Any applicable fee will be disclosed to the Participant at the time of the redemption request and before confirmation.
- Prize redemptions may take up to thirty (30) days to process, may be delayed by identity, security, and fraud verification, and may be paid in more than one installment. No redemption processing time is guaranteed. Solely where a Participant's Customer Account is closed for violation of these Sweeps Rules or the T&Cs, or where required to comply with applicable law, Sponsor/Promoter reserves the right to refund the Participant's Gold Coin purchases in lieu of processing a prize redemption. Sponsor/Promoter reserves the right, in its sole discretion, to limit the number of redemption requests processed for a Customer Account in any given period.
- Sweeps Coins or prizes credited or issued in error are void and may be removed from the Customer Account; the value of any prize mistakenly paid out constitutes a debt owed by the Participant to Sponsor/Promoter, which Sponsor/Promoter may recover by deduction from the Customer Account or any future redemption, or by any other lawful means.
- Sponsor/Promoter may appoint payment administration agents to accept payments and process prize redemptions on its behalf; Sponsor/Promoter is not responsible for the acts or omissions of any such agent beyond the authority granted to it.
7. Entry Conditions & Release
- By Participating, each Participant agrees to:
- comply with and be bound by:
- the T&Cs;
- these Sweeps Rules; and
- the decisions of the Sponsor/Promoter which are binding and final;
- release and hold harmless the Sponsor/Promoter and its parent, subsidiary, and affiliated companies, the prize suppliers, and any other organizations responsible for sponsoring, fulfilling, administering, advertising, or promoting the Sweepstakes, and all of their respective past and present officers, directors, employees, agents, and representatives (collectively, the Released Parties) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye, or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright, or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a Participant’s entry, creation of an entry or submission of an entry, participation in the Sweepstakes, acceptance or use or misuse of prizes (including any travel or activity related thereto) and/or the broadcast, exploitation, or use of entry; and
- indemnify, defend, and hold harmless the Sponsor/Promoter from and against any and all claims, expenses, and liabilities (including reasonable attorneys/legal fees) arising out of or relating to a Participant’s participation in the Sweepstakes and/or Participant’s acceptance, use, or misuse of prizes.
8. Publicity
- Except where prohibited, participation in the Sweepstakes constitutes each Participant’s consent to Sponsor’s/Promoter’s and its agents’ use of Participant’s name, likeness, photograph, voice, opinions, and/or hometown and state for promotional purposes in any media, worldwide, without further payment, notice, or consideration.
9. General Conditions
- Sponsor/Promoter may suspend or terminate the Sweepstakes with immediate effect only where fraud, technical failure, or another factor beyond Sponsor’s/Promoter’s reasonable control impairs the integrity or proper functioning of the Sweepstakes.
- Sponsor/Promoter reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Sweeps Rules or any other promotion or in an unsportsmanlike or disruptive manner. If a Participant is, in Sponsor's/Promoter's best judgment, determined to have engaged in unfair, deceptive, or unethical conduct in connection with the Sweepstakes, Sponsor/Promoter may limit, suspend, or exclude the Participant from the Sweepstakes.
- Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law and, should such an attempt be made, Sponsor/Promoter reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s/Promoter’s failure to enforce any term of these Sweeps Rules shall not constitute a waiver of that provision.
- In all other cases, the Sponsor/Promoter reserves the right to cancel, suspend, and/or modify the Sweepstakes. Any notice regarding cancellation, suspension, and/or modification will be posted on Gains.com at https://gains.com. In the event of cancellation or early termination of the Sweepstakes, Sponsor/Promoter will honor all Sweeps Coins gameplay completed before the time of cancellation and process eligible prize redemptions in the ordinary course; for any discrete advertised promotion with a stated prize, Sponsor/Promoter reserves the right to award the prize by random drawing from among all eligible, non-suspect entries received before the cancellation.
- Whenever we amend these Sweeps Rules in a way that would limit your current rights or which may be to your detriment, we will notify you upon your next visit to the Platform and you will be required to re-confirm your acceptance prior to participating in any Promotional Play. If you do not agree to the amended Sweeps Rules, you may not participate in any Promotional Play.
10. Limitations of Liability
- Insofar as permitted by law in the respective territories, the Released Parties (as defined above) are not responsible for:
- any incorrect or inaccurate information, whether caused by a Participant, printing error, or by any of the equipment or programming associated with or utilized in the Sweepstakes;
- technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software;
- unauthorized human intervention in any part of the entry process or the Sweepstakes;
- technical or human error which may occur in the administration or operation of the Sweepstakes; or
- any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Participant’s participation in the Sweepstakes or receipt or use or misuse of any prize.
- If for any reason a Participant’s Sweeps Coins or winning play is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, Participant’s sole remedy is replacement by Sponsor/Promoter of an equivalent amount of Sweeps Coins.
11. Disputes
- The section of the Terms and Conditions titled 'Binding Arbitration and Class Action Waiver' is incorporated herein by reference with the same force and effect as though fully set forth herein. By agreeing to these Sweeps Rules, you agree to be bound by the dispute resolution and arbitration provisions contained in that section of the T&Cs.
12. Other
- Participants' remedies in connection with the Sweepstakes are subject to the limitations of liability and dispute-resolution provisions of the T&Cs, including the section titled 'Binding Arbitration and Class Action Waiver.'
- All issues and questions concerning the construction, validity, interpretation, and enforceability of these Sweeps Rules, or the rights and obligations of the Participant and Sponsor/Promoter in connection with the Sweepstakes, are governed by, and construed in accordance with, the laws of the State of Delaware, without giving effect to any choice of law or conflict of law rules (whether of the State of Delaware or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Delaware.
- To ensure fairness and the integrity of the promotion to all Participants, the Sponsor/Promoter will respond to questions to Customer Support via email and may post updates on its social media handles.
- Sponsor/Promoter may report violations to the relevant social media platform and may disqualify Participants who harass, abuse, or threaten other participants or Sponsor/Promoter personnel in connection with the Sweepstakes.
- If any provision of these Sweeps Rules is held invalid or unenforceable, that provision shall be struck and the remaining provisions shall be enforced.
- Participants are responsible for retaining their own records of transactions and gameplay; Sponsor's/Promoter's records control in the event of any conflict.
- For a list of winners for a given Sweepstakes Period, email support@gains.com with the subject line 'Winners List Request,' identifying the applicable Sweepstakes Period. Requests must be received within sixty (60) days after the end of that Sweepstakes Period. For purposes of this clause, each calendar quarter constitutes a separate Sweepstakes Period unless Sponsor/Promoter designates otherwise.
